Fire Safety Addendum

 

In executing this addendum, Licensee and Licensor understand, acknowledge, and agree:

1.     All open flame items, including but not limited to, candles, sparklers, grills, fire pits, and fire works are not allowed in the Event Space. Licensee may use items such as a hibachi grill or barbeque pit outside of the Event Space on the property, but accepts all responsibility and liability associated with such use.

2.     Licensee accepts all responsibility and liability associated with use of flammable and/or open flame objects, aids and accessories during the Event and hereby agrees to indemnify, defend, and hold harmless Licensor, its officers, directors, employees, and agents, from any and all damages, liabilities, actions, suits, claims, costs (including reasonable attorneys’ fees), penalties, or expenses arising out of or in connection with, in whole or in part, directly or indirectly with the use of these objects and accessories.

3.     Licensee agrees to follow all local, state, and federal laws and regulations related to the types of objects and accessories described in Section 1.

4.     In the case of fire resulting from Licensee’s use which in any way affects the Event Space, Licensee will immediately notify the fire department (should the fire affect the Event Space structure, floors, or ceiling/roof) as well as Licensor. Small fires not touching the Event Space structure, floors, ceiling, or roof must immediately be put out with water or other acceptable method.

5.     Handheld sparklers may only be used outdoors and at a minimum distance of 50 feet from the Event Space and 50 feet from all other structures on or neighboring the property featuring the Event Space. Larger fireworks of any kind are not permitted.

6.     Smoking, including but not limited to, cigarettes, cigars, vapes, and e-cigarettes, in the Event Space is expressly prohibited. Violation of this provision by Licensee, Licensee’s guests, or Licensee’s Service providers will be considered a default of the Agreement by Licensee, and Licensor, at their sole discretion, may revoke the License immediately.

7.     Licensee will properly dispose of any flammable objects or handheld sparklers. Licensee will not dispose of gasoline, lighter fluid, or similar flammable substances in the Event Space.
