Alcohol Addendum 

Addendum on Alcohol

In executing this addendum, Licensee hereby notifies Licensor of its intent to serve alcohol during the Event.  As such:

1.     Licensee accepts all responsibility and liability associated with service of alcohol and hereby agrees to indemnify, defend, and hold harmless Licensor, its officers, directors, employees, and agents, from any and all damages, liabilities, actions, suits, claims, costs (including reasonable attorneys’ fees), penalties, or expenses arising out of or in connection with, in whole or in part, directly or indirectly with the sale and/or service of alcohol during the Event.

2.     Licensee agrees to follow all local, state, and federal laws and regulations related to service of alcohol at the Event. Licensee agrees to obtain any license or certification necessary to comply with these laws and regulations.

3.     Liquor will only be served in a proper bar setting or by cocktail servers. Licensee may serve beer and wine to guests of the Event without the necessity for bar service or bartenders, provided that the beer and wine is not “for sale” to guests from Licensee. Bartenders may not serve “shots” of alcohol of any type.

4.     The maximum length of time alcohol, including but not limited to liquor, beer, and wine, may be provided during the Event is five hours.

5.     Beverages containing alcohol are not allowed to leave the premises and must stay inside the Event Space.

6.     Any alcohol-related problems, disturbances, including damage to property of any sort, which are not satisfactorily resolved will cause the immediate forfeiture of the entire deposit and/or early closure of the Event.

7.     Licensee may provide their own bar services or may hire a bartending service, subject to the terms of the Agreement, and provided that the bartending service and Licensee are responsible for their own bar equipment and cleanup of any areas used for bar service. Proper disposal of bottles, cans, and any other waste from bar service will be the responsibility of Licensee and/or their bartending service.

8.     Any bar service or bartending service hired by Licensee to serve alcohol to Licensee and Licensee’s guests must be TABC certified.

9.     All alcohol must be served in and consumed in the Event Space. Notwithstanding the foregoing, Licensee may hire a mobile bar service (i.e., a pop-up bar or mobile trailer bar). Provided that such mobile bar service has the appropriate licenses for operating as a mobile bar, Licensee’s mobile bar service may serve alcohol outside of the Event Space, but such alcohol must be consumed in the Event Space.

10.  If Licensee chooses to serve alcoholic beverages at their event, regardless of whether a bartending service is retained or not, Licensee is required, at their sole effort and expense, to retain security for the event to be administered by an off duty public peace officer.
